Terms of Service

These Terms govern your access to and use of Myrtle Beach's Best. Please read them before using an account or submitting content.

1. Acceptance of these Terms

These Terms of Service (“Terms”) are a binding agreement between you and Myrtle Beach's Best (“Myrtle Beach's Best,” “we,” “us,” or “our”) governing the websites, applications, accounts, directory, listing tools, and related services that link to these Terms (collectively, the “Service”).

By accessing or using the Service, creating an account, claiming a listing, or purchasing a product, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for a business or organization, you represent that you are authorized to bind it, and “you” includes that entity.

2. The Service and eligibility

Myrtle Beach's Best is a visitor-focused directory and editorial guide for the Myrtle Beach and Grand Strand area. The Service may include public listings, guides, search tools, business claims, saved content, sponsored placements, advertising, outbound links, and other features that change over time.

You may browse public content without signing in. To create an account, you must be at least 13 and legally capable of agreeing to these Terms. If you are under the age of majority where you live, use account features only with permission from a parent or legal guardian. The Service is intended for users in the United States unless we state otherwise.

3. Accounts and third-party sign-in

You must provide accurate account information, keep your account access secure, and notify us promptly of suspected unauthorized use. You are responsible for activity performed through your account unless prohibited by law. We may require additional verification before allowing a listing claim, payment, sensitive change, or administrative action.

Sign in with Google

When you use Sign in with Google, you authorize Google to authenticate you and provide the account information you approve. Your use of Google services remains subject to Google's terms and privacy policy. We use Google identity information as described in our Privacy Policy and do not receive your Google password.

Sign in with Apple

When you use Sign in with Apple, you authorize Apple to authenticate you and provide the account information you approve. Your use of Apple services remains subject to Apple's terms and privacy policy. If you select Hide My Email, you are responsible for maintaining relay settings that allow you to receive account notices. We will treat the private relay address as your account email and will not require a personal address solely to replace it.

Google and Apple are independent third parties, not our agents. We do not guarantee that either sign-in method will always be available. Revoking a provider connection may prevent future sign-in but does not automatically delete your Myrtle Beach's Best account. A recently signed-in user may disconnect a provider or permanently delete the account through the account page, subject to the confirmation and retention terms described in the Privacy Policy. Email sign-in remains available after disconnecting Google or Apple.

4. Directory information and reliance

Directory and editorial information is provided for general planning and discovery. Businesses, attractions, events, weather, prices, hours, availability, accessibility, safety conditions, and policies can change without notice. Verify material details directly with the relevant business or authority before traveling, purchasing, or relying on a listing.

A listing is not an endorsement, certification, warranty, or guarantee. Sponsored placement is labeled and does not convert paid content into an independent editorial recommendation. Ratings, reviews, awards, or factual claims are not promised unless they are expressly displayed with supporting context.

5. Business listings and claims

If you claim, create, or manage a listing, you represent that you have authority to act for the business and that all submitted information is accurate, lawful, current, and not misleading. You must promptly correct material changes. We may require evidence, contact the business through independently obtained information, reject or revoke a claim, edit formatting, request substantiation, label a listing, or remove content to protect users and directory integrity.

Claiming a listing does not give you ownership of public facts, categories, page layout, URL, aggregate analytics, or editorial content. We retain final control over publication, taxonomy, moderation, disclosures, and organic editorial treatment.

6. User content and license

You retain ownership of content you submit. You grant us a nonexclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, adapt for display and accessibility, publish, distribute, and promote that content only as reasonably necessary to operate, improve, and market the Service and the relevant listing or feature. This license ends when the content is deleted from active systems, except for lawful retention, backups, content already shared at your direction, and rights necessary to resolve disputes.

You represent that you own or have permission to submit the content; it is accurate where presented as fact; and its use will not violate privacy, publicity, intellectual-property, contract, or other rights. Do not upload confidential information, payment-card data, government identifiers, or unnecessary sensitive personal information.

7. Paid services and advertising

Prices, billing periods, deliverables, eligibility, renewal terms, cancellation rules, and refund terms for a paid listing, campaign, or other product will be disclosed before purchase and become part of these Terms. You authorize our payment provider to charge the payment method you select. Taxes may apply. Unless expressly stated, purchasing visibility does not guarantee traffic, leads, sales, search rank, or revenue.

Listing plans renew automatically for the interval shown at purchase. You may cancel renewal in the billing workspace; the cancellation takes effect at the end of the paid period, and you may resume before that date. Standard-to-Premium upgrades require a displayed proration preview and confirmation and may take effect immediately after successful payment. Premium-to-Standard downgrades take effect at the next renewal. We do not advertise a free trial or promise an automatic prorated refund. Refunds remain available when required by law or expressly stated in the offer or support resolution.

Paid placements and advertisements will be identified using labels such as “Sponsored” or “Ad.” We may reject or stop a campaign that is misleading, unlawful, unsafe, incompatible with the Service, or likely to damage user trust. Organic editorial decisions remain under our control.

8. Acceptable use

You may not:

  • violate law or another person's rights;
  • impersonate a person or business, submit a fraudulent claim, or misrepresent affiliation, authorization, sponsorship, or facts;
  • upload malware, exploit vulnerabilities, interfere with security, overload the Service, or bypass rate limits or access controls;
  • scrape, harvest, copy, or build a competing database from the Service through automated means without our written permission, except for ordinary search-engine crawling allowed by our robots rules;
  • collect personal information from the Service for unsolicited marketing, surveillance, discrimination, or unlawful profiling;
  • manipulate reviews, engagement, rankings, advertising metrics, or attribution;
  • reverse engineer or circumvent technical protections except where a legal right cannot be waived;
  • use the Service to create or distribute unlawful content.

9. Third-party services

The Service may link to or integrate maps, booking platforms, restaurants, hotels, attractions, identity providers, payment processors, advertisers, and other third parties. We do not control their availability, content, security, accessibility, terms, privacy practices, prices, reservations, or performance. Your dealings with a third party are between you and that third party. Review its terms before providing information or purchasing.

10. Intellectual property

Except for user content and third-party materials, the Service, including its design, software, compilation, original text, graphics, trademarks, and branding, is owned by or licensed to Myrtle Beach's Best and protected by law. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Service for personal planning or authorized internal business management. No other rights are granted.

Apple, Google, and other third-party names and marks belong to their respective owners. Their appearance does not imply endorsement of Myrtle Beach's Best.

11. Privacy and communications

Our Privacy Policy explains how we handle personal information. By providing an email address, you agree to receive service, security, claim, billing, and legal communications electronically. You may opt out of promotional messages, but not messages reasonably necessary to operate your account or complete a transaction.

12. Suspension and termination

You may stop using the Service at any time and may delete your account through the account page or request assistance under the Privacy Policy. We may suspend, restrict, or terminate access; remove content; or revoke listing control if we reasonably believe you violated these Terms, created risk or legal exposure, acted fraudulently, failed required verification or payment, or threatened the integrity of the Service. Where appropriate, we will provide notice and an opportunity to correct the issue.

Provisions that by their nature should survive termination will survive, including ownership, licenses needed for retained content, disclaimers, liability limits, indemnification, and dispute terms.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and any warranty arising from course of dealing. We do not warrant that content is complete or current, that the Service will be uninterrupted or error-free, or that a business, event, product, or destination will meet your expectations.

The Service does not provide emergency, medical, legal, safety, or official travel advice. Contact appropriate authorities or qualified professionals when those needs arise. Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, Myrtle Beach's Best and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, travel costs, business interruption, or substitute services, arising from or related to the Service, third-party conduct, a listing, or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by law, our aggregate liability for all claims arising from or related to the Service or these Terms will not exceed the greater of the amount you paid us during the six months before the event giving rise to the claim or one hundred U.S. dollars ($100). These limitations do not apply where liability cannot legally be limited.

15. Indemnification

To the extent permitted by law, if you use the Service for a business or submit content or a listing claim, you will defend, indemnify, and hold harmless Myrtle Beach's Best and its owners, officers, employees, contractors, and agents from third-party claims, damages, losses, liabilities, and reasonable legal fees arising from your content, your business or listing, your violation of these Terms, or your infringement of another person's rights. This does not require indemnification for our own unlawful conduct.

16. Governing law and disputes

South Carolina law governs these Terms, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Before filing a claim, you and we agree to make a good-faith effort for 30 days to resolve it informally after written notice. Notices to us may be sent to the email in Section 18.

Unless applicable law gives you another right, state and federal courts located in Horry County, South Carolina will have exclusive jurisdiction, and you consent to their personal jurisdiction. We may seek injunctive or equitable relief in any court with jurisdiction to protect security, confidential information, or intellectual property.

17. Changes and miscellaneous

We may update these Terms by posting a revised version and changing the date above. We will provide additional notice of material changes when required. Continued use after the effective date means you accept the revised Terms; if you do not agree, stop using the Service.

These Terms, the Privacy Policy, and any purchase-specific terms are the entire agreement concerning the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a term is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, or transfer of the Service, subject to applicable law. Headings are for convenience only.
